A probationary cop who blamed testing positive for cocaine on some coca tea can't have his job back, a Manhattan judge has ruled.
Alvaro Casado, who was fired by the NYPD last March, had sued to challenge his termination, saying he likely tested positive because he drank Mate de Coca tea his girlfriend's mother gave him after he was in a car accident.
But Supreme Court Justice Saliann Scarpulla said Casado has no case, pointing out that probationary cops can be canned without a hearing for almost any reason or no reason at all - as long as the decision isn't in bad faith.
"Here, Casado fails to point to any competent evidence demonstrating that NYPD's determination to terminate his employment was in bad faith, for an impermissible reason, or in violation of statutory or decisional law," she wrote.
Casado had claimed he was unaware of coca tea's connection to cocaine when he drank it shortly after he was in a car accident in October 2009.
The Air National Guard accepted Casado's story, deciding that the senior airman would face no disciplinary action for a positive drug test because he "did not knowingly ingest an illegal substance."
He now joins the ranks of NYPD officers who blamed failed drug tests on unusual circumstances, including a cop who said his wife spiked his meatballs with marijuana and another who said he ingested cocaine after performing oral sex on a girlfriend who had used the drug.
