If two pole dancers accused of prostitution try to mount a lesbian defense, prosecutors have a secret weapon: a boyfriend.
Cassandra Malandri and Falynn Rodriguez are on trial for allegedly offering a cop sex for $5,000 at the Hot Lap Dance Club in 2008.
"One of their defenses may be that they're lesbians," Manhattan Assistant District Attorney Daryl Reed said in court Wednesday.
"We should be allowed to call her so-called fiancé to rebut her."
They slapped a subpoena on the anonymous man who is romantically entangled with Malandri, better known as porn star Alexia Moore.
Lawyers for Malandri and Rodriguez cried foul and said the prosecution's logic - the idea that someone could claim lesbians don't have sex with men for money - is faulty.
"It doesn't even make sense," said defense lawyer Ikiesha Al-Shabazz.
Prosecutors issued the subpoena after the two sides tangled over whether the man should be allowed to stay in a closed courtroom while an undercover cop testified.
The judge ruled that if the man wanted to stay he would have to reveal his name. The judge ruled he's out because he would not identify himself.
The courtroom is being closed to the general public because of an unrelated death threat against the cop.
