One month after being sentenced to 30 years in prison on racketeering, attempted murder and firearm charges, Kay Flock has appealed his conviction. The appeal, reviewed in legal documents by Complex, comes as no surprise, as Kay Flock’s lawyer, Michael T. Ashley, said he had “little doubt” that such action would be taken after the sentencing. Ashley proposed that the rapper, real name Kevin Perez, would either receive the statutory minimum of 10 years, or cooperate in a multi-year, 11-point "punishment plan," which saw his client moving to Los Angeles, getting his GED, staying drug and alcohol free, using social media to condemn acts of violence, and more. Assistant US Attorney Patrick Moroney pushed for Perez to receive 50 years behind bars, adding, "That's not an ask that we make lightly." Moroney argued that the rapper "perpetuated the cycle of killings. He bragged about it... He taunted his rivals to come to his territory and shoot." Perez was found guilty in March 2025 on charges of racketeering conspiracy, use of a firearm resulting in death, attempted murder and assault with a dangerous weapon in aid of racketeering, and use of a firearm for attempted murder and assault with a dangerous weapon.These charges stem from his connection to four shootings in 2020 and 2021, that were meant to advance the Sev Side/DOA gang, in which Perez was the leader. Even though the rapper was not the shooter in any of these incidents, Judge Lewis Liman did not believe that meant he should not be held accountable. "I recognize you were not the gunman," Judge Liman said. "In some ways, it was a measure of the fact that you were a leader that you distanced yourself from the shooting." When attempting to appeal for a lighter sentence, Ashley mentioned that Perez was 13 years old when he joined Sev Side/DOA under the influence of a decade-older man who "used him for his own ends." Judge Liman countered this argument during Perez's sentencing by pointing out how he has done to younger generations what was done to him.
