Giants linebacker Michael Boley has been accused of abusing his 5-year-old son and is being investigated by police in Alabama, according to a report Saturday morning on TMZ.com.
According to the website, the case was investigated by police in Gadsden, Ala. – Boley's hometown – and has been turned over to the District Attorney, who will present the case to the grand jury. The incident report accuses Boley of "the repeated willful abuse of a child under 18 from May 30 to June 5," TMZ.com said.
Giants spokesman Pat Hanlon said the organization is "aware of the situation." Boley is still expected to play on Sunday against the Washington Redskins.
Boley's attorney, Randall M. Kessler, told TMZ.com the allegations were made by the child's mother in a child support case.
"These allegations were brought to our attention along with outrageous monetary demands in a contested child support case which she filed over a year ago," Kessler told the site. "At final trial about a month ago, she did not seek an order restricting visitation. The only relief she requested from the judge was that child support be more than quintupled to, in her words, 'increase her lifestyle.'"
The site also reported that another mother of one of Boley's children has filed court papers in Georgia asking a judge to require Boley to be supervised when he visits with their 2-year-old son. No ruling has been issued in that case yet.
Boley, who signed a $25 million contract with the Giants in 2009, has not been charged with any crimes yet and it's not known when the grand jury will hear the case in Alabama.
Boley does have history of alleged domestic violence. In May, 2008, he was arrested in Gwinnett County, Ga., and charged with three counts of domestic battery for allegedly beating his wife, Chantelle. Among other acts, he allegedly pushed his wife into a kitchen cabinet door, leaving bruises on her upper back.
The prosecutor eventually decided not to pursue the case. However, the NFL suspended Boley for the first game of the 2009 season for violating the league's personal conduct policy.
