Tracy Morgan is struggling to recover two months after he was nearly killed in a tragic New Jersey Turnpike wreck, his lawyer said.
The "30 Rock" star's attorney, Benedict Morelli, told the Daily News that the 45-year-old comedian has made some progress in his recovery, but still has a long way to go.
"The truth is he's struggling, but he's fighting hard," Morelli said on Monday.
"He's got the fighting spirit, but every day is different. Some days he's very down."
Morgan was left in critical condition - with several cracked ribs and a severely broken leg - after a Wal-Mart tractor-trailer plowed into his Mercedes-Benz limousine van filled with several of his friends on June 7.
The comedian's longtime friend and mentor James (Jimmy Mack) McNair was killed in the crash, while Morgan, his assistant Jeffrey Millea, and comedian Ardie Fuqua were all injured.
Morelli said Morgan can't shake feeling responsible for the deadly accident.
"It's not only physical, it's emotional," said Morelli, who also spoke about Morgan's recovery on NBC's "Today."
Rumors about Morgan's condition after the accident ranged from claims that he had died, to news that his leg had been amputated.
"Now, there's been a couple of people who said he's doing great," Morelli said. "And that's not true. What is true is he's struggling and he's fighting."
The truck's driver, Kevin Roper, pleaded not guilty to charges of vehicular homicide and assault. Wal-Mart called the accident a "terrible tragedy," and has vowed to cooperate with the ongoing investigation. The retail giant also said it would take "full responsibility" if Roper was found to be at fault.
Morgan and the other crash survivors have filed a lawsuit against the company.
Last month Morgan was photographed for the first time since his accident outside of his home in Cresskill, New Jersey - flashing a smile while using a walker, and telling photographers he feels "strong."
