Jay Z scored a tentative pretrial victory Wednesday in a civil lawsuit claiming he swiped a song sample for his smash hit “Big Pimpin.”
A U.S. District judge said she planned to split the case into separate liability and damages phases — meaning jurors for the October trial won’t hear testimony about the rapper’s eye-popping personal wealth unless they first find him liable of copyright infringement.
“I really do think bifurcation at this stage is appropriate,” said Judge Christina Snyder. She’s expected to finalize the ruling before the trial starts on Oct. 13.
Jay Z and co-defendant Tim (Timbaland) Mosley would be “happy” to return for a second round of testimony if necessary, one of their lawyers said in court.
The suit was brought in 2007 by a relative of Egyptian composer Baligh Hamdi, who said “Big Pimpin” ripped off Hamdi’s 1960 song “Khosara, Khosara.”
Jay Z’s lawyer said she was concerned about “significantly large dollar signs” taking center stage before jurors decided on liability.
“We won’t find a juror who doesn’t understand Jay Z is very successful,” Snyder said.
