Derrick Rose is in for an ugly week, and it has nothing to do with the start of the NBA preseason.
A civil trial accusing the new Knick of gang raping a female friend three years ago is set to begin with jury selection on Tuesday, and will feature disturbing allegations that he and two friends preyed on the woman when she was blind drunk and possibly drugged.
Rose maintains the encounter was consensual — and court filings show he’s planning to trash the accuser’s reputation to save his own.
Lawyers for the former Chicago Bull have asked the judge who’ll be presiding over the case in California federal court to allow them to bring up the accuser’s sexual history.
Her lawyers say her history is irrelevant.
“Her past sexual conduct (as alleged by defendants) does not, as defendants would argue, create emotional calluses that lessen the impact of unwelcomed sexual assault and battery,” her lawyer Brandon Anand wrote in a motion filed Wednesday.
But the accuser’s attorneys plan on bringing up Rose’s history of haranguing their client to join in threesomes and foursomes, and to portray him as an oversexed clod who doesn’t understand the meaning of the word consent.
The judge has noted the entire case hinges on the credibility of the woman, identified only as “Jane Doe.”
Rose and the woman met in October 2011 at a party he was hosting in Los Angeles after being invited by mutual friends.
“Rose approached Jane and they talked. Jane was impressed that Rose seemed shy even as the host of the event,” her suit says.
They began texting with each other and went to dinner at his agent’s house. They soon “formed an intimate relationship with one another,” the suit said.
They went to parties and basketball games together, and Rose started pushing their non-exclusive relationship into areas the woman was uncomfortable with, her suit says. That included sexting and pressure to involve additional people in their trysts.
He started “obsessively asking Jane to involve others in their sex life, in particular strippers and other couples,” the suit says.
His wish came true in May of 2013, when she and a female friend had a tryst with Rose, her suit says.
Doe said she didn’t enjoy it — especially how Rose hit it off with his friend — so she was upset a month later when he started pressuring her to have a foursome with his friend Randall Hampton, the suit says.
“I need that,” he texted her.
She refused — and that July he briefly broke up with her, the suit says.
A month later, Rose invited her to his rented home in Beverly Hills, where he was hanging out with Hampton and another pal, Ryan Allen.
She says they “schemed” to get her drunk and drug her, but a friend of hers took her home before anything happened.
The trio then went to her apartment, knowing she was “drugged and incapacitated,” and raped her, her suit says.
Rose maintains nobody drugged her — and they went to her place because she wanted them to. He said she’d texted him that she’d left her “sex belt” — a belt with handles on its sides — at his home and she wanted him to come over with it.
His lawyers plan on showing jurors those texts and other sexually suggestive ones he’d sent her, and are expected to highlight that she didn’t go to police until well after she filed the $21 million suit — and that was already two years after the alleged assault.
They also plan on calling one of her friends as a witness, who said Doe told her she’d willingly had sex with the trio and was upset with Rose for not paying attention to her.
Doe’s lawyers plan to focus on Rose’s own deposition testimony, where he appeared confused about the meaning of the word consent.
They also say they’ll call other witnesses who Doe did tell she was raped — and have asked to play video of her emotional response to Lady Gaga’s performance of the anti-rape anthem “Til It Happens to You” at the Oscars in February.
Rose has indicated he doesn’t want to settle the case because he believes he’ll be vindicated.
“As far as the trial that’s something I can’t think about because it’s not true,” Rose told reporters last week. “I will be proven innocent.”
Doe has told the Daily News Rose knows that he hurt her.
“He has to deal with what he did to me with his friends,” she said. “I think that alone is a huge deal for him, whether he’s showing it or not.”
