Cardi B says she didn’t have an easy time after the birth of daughter Kulture.
According to court documents obtained by The Blast as part of an ongoing lawsuit, Cardi has yet to sit for a deposition in the suit due in part to health problems resulting from the birth.
Cardi’s attorney revealed that she “suffered unanticipated post-partum complications sufficiently serious enough to cause her, among other things, to have to cancel an upcoming and much-publicized tour, performing with Bruno Mars.”“Her condition also made it impracticable for her to fully participate, for some weeks, in completing factual investigation and complete the pending jurisdictional discovery.”
Cardi is fighting a lawsuit against Kevin Michael Brophy, Jr., who accused her of using his image for the cover art for “Gangsta Bitch Music Vol. 1.” Brophy alleged that Cardi, 25, didn’t get permission to use his image and requested $5 million in damages.
Just weeks after giving birth to Kulture, Cardi said of leaving the tour with Bruno Mars, “I thought that after giving birth to my daughter that 6 weeks would be enough time for me to recover mentally and physically. I also thought that I’d be able to bring her with me on tour, but I think I underestimated this whole mommy thing … Not only am I just not ready physically, I’m not ready to leave my baby behind since the doctors explained it’s not healthy for her to be on the road.”
As far as the lawsuit goes, Cardi’s team alleged in court documents that Brophy was using “extortionate means” because the image was a “classic example of transformative work created in the exercise of the First Amendment rights of the photographer.” She and her lawyer claim that any allegation that her success can be attributed to Brophy’s image was “simply ludicrous.”
