A Brooklyn tattoo artist Thursday will sue the NYPD and city for $220 million claiming a city cop sodomized him with a baton, the man's lawyers said.
Michael Mineo's civil rights were violated on a Prospect Park subway platform last October, one of his lawyers, Stephen Jackson, said.
"We are filing a formal lawsuit. It is another step towards justice," Jackson said last night.
NYPD Police Officer Richard Kern was formally charged with attacking Mineo and two other cops were accused of covering up the alleged subway station attack. A criminal trial is expected to begin this fall.
The officers' lawyers said their clients were innocent.
Brooklyn District Attorney Charles Hynes said Mineo fled into the station after cops accused him of smoking pot. He jumped a turnstile before he was pinned down and handcuffed near a token booth.
Mineo claims cops pulled down his pants and one of the officers sodomized him with a police baton as he screamed out in pain. He was given a ticket for disorderly conduct and released.
Hynes said cops warned Mineo he would be charged with a felony if he reported the attack. Papers will be filed today in Brooklyn federal court.
