CITY WANTS 2 QUIETLY SETTLE A SUIT FILED BY A MAN WHO WAS STOPPED & FRISKED 21 TIMES CAUSE OF RACIAL PROFILING! GEE! I WONDER WHY?

The city has quietly settled with a southeast Asian man who accused the NYPD of racial profiling because he's been searched 21 times at subway entrances, the Daily News has learned.

Brooklyn hospital worker Jangir Sultan filed the suit only three months ago. As recently as April 9, a lawyer for the city tried to have the complaint dismissed.

Federal Judge Raymond Dearie issued an order in Brooklyn Federal Court last week revealing the case had been settled. Terms of the settlement will not be publicly available until later this month.

"There's nothing I can say about the case at this time," Christopher Dunn of the New York Civil Liberties Union, who represented Sultan, said yesterday.

NYPD spokesman Paul Browne said there are "no plans to change the program and we don't believe ... he was singled out."

Sultan, of Kashmiri descent, claimed he had been stopped 21 times since the NYPD instituted subway bag searches in 2005 in response to terrorist bombings in London.

Most of the stops occurred at the Borough Hall station near his home in downtown Brooklyn.

Sultan's lawyers said the chances of being randomly stopped that many times is 1 in 165 million.

When the city's assistant corporation counsel David Hazan was still fighting the suit, he denied any racial profiling.

He argued that if cops stopped every third or fifth subway rider carrying a bag, Sultan's probability of being stopped would be 1 out of 3 or 1 out of 5.

Sultan's lawyers also wanted to require the NYPD to record demographic information of persons stopped in the program. Dunn declined to say whether a policy change is part of the settlement.
